A. MOTION TO APPROVE Agreement No. LC962 between the State of Florida Department of Children and Families (DCF) and Broward County for the five-year period beginning July 1, 2025 and ending June 30, 2030 in the total amount not to exceed $2,172,790, for the purpose of conducting licensing activities for child care facilities and family child care homes in Broward County; and authorizing the County Administrator to execute renewal options and amendments to the Agreement, subject to approval of same for legal sufficiency by the Office of the County Attorney, provided there is no modification to the funding amount set forth in the Agreement, and to take any necessary administrative and budgetary actions during the term of the Agreement; authorizing the Mayor and Clerk to execute same.

B. MOTION TO APPROVE Memorandum of Understanding (MOU) between the State of Florida Department of Education Division of Early Learning and Broward County, providing for the County to perform School Readiness Program inspections, effective July 1, 2025, or the date on which it is signed by both parties, whichever is later; authorizing the Mayor and Clerk to execute same; authorizing the County Administrator or written designee to sign the Vendor Certification Form; and to authorize the County Administrator to take the necessary administrative actions to implement the MOU.

Summary Explanation/Background
THE RESILIENT ENVIRONMENT DEPARTMENT AND THE CONSUMER PROTECTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
Approval of these motions permit Broward County’s Child Care Licensing and Enforcement Section to continue providing child care provider and School Readiness Program inspection services for the State of Florida.
Section 402.306, Florida Statutes, provides that counties may either designate a local licensing agency or contract with DCF to license child care facilities and family child care homes. In Broward, the Board of County Commissioners has designated the Consumer Protection Division’s Child Care Licensing and Enforcement Section (CCLE) as the local licensing agency. Since 1985, the DCF has contracted with Broward County’s CCLE to provide child care provider inspection services. DCF provides partial funding for CCLE through this contract to provide licensure and administrative oversight, monitoring, and enforcement for child care facilities and family child care homes for compliance with the standards for education, training, health, safety, sanitation, and nutrition requirements set forth in Chapter 7, Broward County Code of Ordinances, the “Broward County Child Care Ordinance.”
The School Readiness (SR) Program promotes child development through funding to child care providers meeting the requirements of the SR Program. Pursuant to Section 1002.82(2)(i), Florida Statutes, the State of Florida, Division of Early Learning (DEL) is required to enter into a memorandum of understanding with local licensing agencies to monitor SR Program providers.
Agreement No. LC962 (Exhibit 1) and MOU (Exhibit 2) have been approved as to form by the Office of the County Attorney. Agreement No. LC962 is on a form provided by DCF and includes provisions that differ from County standards, such as obligations that the County indemnify DCF for the negligence of County employees or the misuse of intellectual property by County employees. In addition, the County must follow a variety of State procedures and complete State-mandated forms, and venue for any dispute would lie in Leon County. The MOU is on a form provided by the Florida Department of Education and includes provisions that differ from County standards. A budget resolution must be approved to recognize the unanticipated revenue and allow expenditure of the associated funds (Exhibit 3).
