Why Action is Necessary

Board action is required to allow subordination of the Broward County Mortgage.

 

What Action Accomplishes

Authorizes the County Administrator to subordinate Broward County’s Mortgage, which is necessary to grant the City of Dania Beach (“City”) an access and utility easement for a potable water distribution line servicing the City Place Apartments affordable housing development and may be necessary in the future in the routine operation of the subject property.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s Value of “Ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity."

 

On October 11, 2022, Agenda Item No. 24, the Board of County Commissioners (“BOCC”) approved gap financing in the amount of $3,000,000 to City Place Apartments Ltd. (“Owner”), for construction and permanent financing of a 99-unit affordable housing development located at 59 Southwest Third Avenue, Dania Beach, Florida (“Property”) generally located as depicted in Exhibit 2.

 

The Owner installed a potable water distribution line for provision of potable water to the Property.   An Access and Utility Easement (Exhibit 1) is necessary to provide the City access for maintenance of the water line, which requires Broward County to subordinate the mortgage on the Property in favor of the City via execution of the Joinder (Exhibit 1, Page 13). The execution of the Joinder will allow the Property to receive its Temporary Certificate of Occupancy (“TCO”) from the City.

 

As a routine part of the operation of developments similar to and including the Property, it is expected that a need for execution of subordinations and joinders similar to the Joinder will arise. Such subordinations and joinders also do not impact material interests of the County and may require prompt execution.
