Why Action is Necessary

In accordance with the Broward County Procurement Code, Board approval is required to approve amendments to agreements in excess of the award authority of the Director of Purchasing.

 

What Action Accomplishes

Extends Agreement for General Planning Consultant services for one additional renewal term and adds up to an additional $1,000,000 for work authorizations between the effective date of the Amendment and the end of the renewal term as staff continues the Request for Proposal (RFP) procurement process for a new continuing services agreement for similar services.

Summary Explanation/Background

THE TRANSPORTATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.

 

The current Agreement with WSP USA Inc. for General Planning Consultant Services (RFP#PNC2119955P) for the Transportation Department (BCT) commenced on May 4, 2021, for an initial term of three years (May 4, 2021, through May 3, 2024), with up to two additional one-year renewals, both of which have been exercised, extending the term of the Agreement until May 3, 2026. Pursuant to the terms of the Agreement, all services are ordered by work authorizations with specific scopes of work and funding maximums. The total annual maximum for all work authorizations issued during each contract year is $1,000,000. The services provided by WSP USA Inc. support the Transportation Department’s planning needs including capital project planning and development; environmental planning; economic development planning; organizational assessment, research, analysis, and planning; information technology planning and/or integration; public involvement and outreach; and grants compliance, monitoring, and development.

 

To avoid gaps in the planning services provided by WSP USA Inc., the Transportation Department is seeking to amend the Agreement to add an additional one-year renewal term (from May 4, 2026, through May 3, 2027) and up to an additional $1,000,000 in funding for work authorizations issued between the effective date of the Amendment and the end of the extended term. This Amendment is being brought before the Board because the Director of Purchasing only has the authority under the Procurement Code to provide an additional one-year renewal term but does not have the authority to approve funding over $500,000.

 

If this item is approved, the existing Agreement will be extended for one additional year (through May 3, 2027), and an additional $1,000,000 in funding will be available for work authorizations issued between the effective date of the Amendment and the new expiration date. Detailed scopes of services will be developed for each work authorization issued under the Agreement. The extension to the Agreement and additional funding will allow the Transportation Department to continue having access to the planning services provided for in the Agreement as the procurement process continues for a new general planning agreement. The additional funds requested are budgeted in BCT’s Fiscal Year 2026 Transportation Surtax Capital Fund.

 

The proposed Second Amendment has been reviewed and approved for legal sufficiency by the Office of the County Attorney.
