Why Action is Necessary

In accordance with Broward County Procurement Code Section 21.47, Award and Execution Authority, Board approval is required for awards with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract, that include a single bidder, rejection of apparent low bidder, protested award, or pulls from the Board regarding the intended award.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PUBLIC WORKS DEPARTMENT/WATER & WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) designated this project as a reserve opportunity for certified Small Business Enterprise (SBE) firms. Chin Diesel, Inc. is a certified SBE, and therefore is considered compliant (Exhibit 2).

 

This contract provides for the furnishing and delivery of aggregates to County various locations.

 

The Director of Purchasing has determined the apparent low bidder, Austin Tupler Trucking, Inc., to be non-responsible to the bid requirements based on non-compliance with the solicitation’s SBE Reserve requirements. The difference in the bid amount of the apparent low bidder (non-SBE) and the low, responsive, responsible bidder (SBE) is $8,020 annually.

 

Water & Wastewater Services has reviewed the bid submitted by Chin Diesel, Inc. and concurs with the recommendations for award (Exhibit 3).

 

No County vendor performance evaluations have been completed for Chin Diesel, Inc.

 

The Purchasing Division reviewed the prices submitted by Chin Diesel, Inc. and has determined that the prices submitted are fair and reasonable in comparison to the next bidder and the previous Broward County contract for the same services (Exhibit 4).

 

The bid was advertised on June 24, 2024, and opened on July 3, 2024; four bids were received with one declination (Exhibit 1).

 

The Recommendation for Award was posted on the Purchasing Division website from September 16 - 23, 2024. There was no protest filed against this procurement.

 

Chin Diesel, Inc.’s bid validity expired on October 31, 2024, and Chin Diesel, Inc. has agreed to extend it through December 31, 2024.

 

The contract consists of the County’s solicitation and the vendor’s response.

 

The initial contract period begins on date of award.
