AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO EDUCATIONAL IMPACT FEE COLLECTION; AMENDING SECTIONS 5-182.9, 5-182.13, 5-184, AND 27-66 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”), PROVIDING FOR COLLECTION OF EDUCATIONAL IMPACT FEES AND THE ISSUANCE OF DEVELOPMENT AND ENVIRONMENTAL REVIEW APPROVALS; AMENDING CHAPTERS 5 AND 27 TO UPDATE REFERENCES TO ENVIRONMENTAL REVIEW APPROVALS; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Board”) at its meeting of October 21, 2025.

Summary Explanation/Background
On August 21, 2025, Item No. 66, the County Commission terminated for convenience an Interlocal Agreement Related to School Impact Fee Monies (“ILA”) between Broward County and The School Board of Broward County, Florida (“School Board”), and directed the County Attorney’s Office to draft necessary amendments to the Code to effectuate the transfer of educational impact fee collection responsibility. Consistent with the termination of the ILA, the proposed amendments transfer responsibility for the collection of educational impact fees to the School Board.
