Summary Explanation/Background

THE PURCHASING DIVISION AND THE TRANSPORTATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

This item supports the Board’s Connected Community Goal, “Cooperatively delivering an efficient and accessible regional intermodal transportation network.”

This approves an Agreement between Broward County and Gannett Fleming, Inc. (Gannett) to perform a Project Development and Environmental (PD&E) Study, required by the National Environmental Policy Act (NEPA) to obtain clearance from the Federal Transit Administration (FTA). Gannett will conduct preliminary engineering analysis and develop design documents for the proposed fixed guideway system, originating from the Fort Lauderdale-Hollywood International Airport Intermodal Center and running through Port Everglades and the Greater Fort Lauderdale Broward County Convention Center (Project). Additionally, Gannett is required to prepare capital, operating and maintenance costs to support the financial plan for the Project (Exhibit 1).

The Office of Economic and Small Business Development (OESBD) established a Disadvantage Business Enterprises (DBE) goal of 30% for this Agreement. Gannett Fleming, Inc. committed to 31.50% DBE participation, which has been reviewed and approved by OESBD (Exhibit 2). The OESBD determined that this Agreement is not subject to the Workforce Investment Program.

The RFP was advertised on June 27, 2024, and, at the time of the submittal deadline on August 21, 2024, five firms submitted proposals: Colliers Engineering & Desing, Inc.; Dromos GmbH; Gannett Fleming, Inc.; HNTB Corporation; and Parsons Transportation Group, Inc.

On October 7, 2024, an Initial Evaluation Committee (EC) meeting was held. During the EC meeting, the EC passed a motion that determined that Dromos GmbH as non-responsive to the RFP requirements; the EC passed a motion to accept the remaining four firms as responsive and responsible to the RFP requirements to proceed to the Final EC meeting to be numerically scored and ranked by the EC.

On October 15, 2024, the Final EC meeting was held. After presentations, evaluation, scoring, and ranking, the EC named Gannett Fleming, Inc. as the first-ranked firm.

The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from October 18 - 23, 2024, which provided an opportunity for any proposer or interested party to object. No objection was submitted within this timeframe.

The EC’s final recommendation of ranking was posted on the Purchasing Division website from October 24 - 30, 2024, which provided an opportunity for any aggrieved proposer to file a protest. There were no vendor objections, protests, or pulls from the Board for this RFP ranking.

On October 31, 2024, in accordance with Procurement Code Section 21.42(k), Procedures for RFPs, RLIs, and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.

Eight negotiation meetings were held to negotiate the Agreement with Gannett Fleming, Inc.: December 10, 2024; December 16, 2024; December 20, 2024; January 22, 2025; January 24, 2025; January 31, 2025; February 12, 2025; and February 14, 2025. The negotiation meetings were attended by representatives from Gannett Fleming, Inc., the Transportation Department, the County Attorney’s Office, and the Purchasing Division.

All services to be performed under the Agreement will be set forth in separate Work Authorizations. The proposed agreement contains certain non-standard terms for disclosure to the Board:

•                     The Contract Administrator (the Transportation Department Director or designee) will have authority to approve any Work Authorization, up to $500,000 (the standard contract language caps this amount at $50,000 per Work Authorization).

•                     The County Administrator will have authority to approve any Work Authorization, up to the Agreement total amount (the standard contract language does not contain this provision).

Additional supporting documentation provided to the EC regarding this procurement can be found on the Purchasing Division website at <https://www.broward.org/Purchasing/Pages/Repository.aspx>.

All dollar amounts referenced in this agenda item have been rounded to the nearest whole dollar.

The initial Agreement period begins on the date of award and terminates four years from that date. Additionally, the Agreement provides for up to an additional one-year extension for the completion of the services.

The Agreement has been reviewed and approved for legal sufficiency by the Office of the County Attorney.
