Summary Explanation/Background

THE PUBLIC WORKS DEPARTMENT/SOLID WASTE AND RECYCLING SERVICES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

On October 11, 2022 (Item No. 6), the Board of County Commissioners approved the Temporary Revocable License Agreement (“Agreement”) with Florida Gas Transmission Company, LLC (“Licensee”) for nonexclusive access to a temporary workspace and construction staging area to facilitate installation of a natural gas pipeline owned by Licensee and located on easements within County-owned property located at 4400 South  State Road 7 in the Broward Municipal Services District (Exhibit 1).

Licensee seeks to amend Exhibit B of the Agreement, Permitted Activities, to enable Licensee to conduct maintenance and federally required testing activities on the installed natural gas. If approved, this item will amend the Agreement to: (i) allow Licensee to undertake testing and maintenance activities in compliance with applicable statutory, regulatory, and permit requirements; and (ii) formally extend the Agreement through October 11, 2025, at which time the County may further extend for up to the two remaining additional one year terms under the Agreement (Exhibit 2).
