Why Action is Necessary
In accordance with the Broward County Procurement Code, Section 21.47, Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions.

Summary Explanation/Background
The PURCHASING DIVISION AND THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT/WATER AND WASTEWATER SERVICES RECOMMEND APPROVAL OF THE ABOVE MOTION.
The Office of Economic and Small Business Development (OESBD) established a County Business Enterprise (CBE) goal of 16% for this Agreement. Chen Moore and Associates, Inc. committed to 16% CBE participation, which has been reviewed and approved by OESBD (Exhibit 2).
The Agreement provides for engineering services for the rehabilitation of four existing sanitary sewage master pump stations. Services include design, permitting, bidding and award assistance, and construction engineering services for Water and Wastewater Services.
The RFP was advertised on August 13, 2025 and, at the time of the submittal deadline on September 12, 2025, five firms submitted proposals: Chen Moore and Associates, Inc.; CSA Central, Inc.; GFT Infrastructure, Inc.; HBC Engineering Company, and Premiere Design Solutions, Inc.
On December 10, 2025, an Initial Evaluation Committee meeting was held. The Evaluation Committee (EC) determined that all five firms were both responsive and responsible to the RFP requirements.
On December 19, 2025, a Final Evaluation Committee meeting was held. After presentations, evaluation, scoring and ranking, the EC named Chen Moore and Associates, Inc. as the first-ranked firm; GFT Infrastructure, Inc. as the second-ranked firm; Premiere Design Solutions, Inc. as the third-ranked firm; CSA Central, Inc. as the fourth-ranked firm; and HBC Engineering Company as the fifth-ranked firm.
The EC’s proposed recommendation of ranking was posted on the Purchasing Division website from January 5 - 8, 2026, which provided an opportunity for any proposer or interested party to present any new or additional information regarding the responsibility of the proposers.
The EC’s final recommendation of ranking was posted on the Purchasing Division website from January 9 - 15, 2026, which provided an opportunity for any aggrieved proposer to file a formal protest. No formal protest was received.
On January 16, 2026, in accordance with the Procurement Code, Section 21.42(k), Procedures for RFPs, RLIs and RFQs, the ranking of the qualified firms became final, and staff proceeded with negotiations.
Three negotiation meetings were held - February 10, March 13, and March 25, 2026, - to negotiate the Agreement with Chen Moore and Associates, Inc. These meetings were attended by representatives from Chen Moore and Associates, Inc. and staff from Water and Wastewater Services, the County Attorney’s Office, and the Purchasing Division.
The Agreement includes the following deviation from Broward County’s template agreement:
Article 4. Time for Performance; Damages, Section 4.5 was modified to allow, at the request of the County, for the Consultant to continue to provide services for one or more extension periods, not to exceed six months in the aggregate, instead of the standard three-month aggregate.
