Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
Pine Island Road from SW 36 Street to Nova Drive, a County road located in the Town of Davie, has water utilities owned and maintained by the City of Sunrise. Broward County is improving this approximately one-mile segment of Pine Island Road. The improvements include the widening of this segment from four to six lanes and installing Complete Streets elements such as wider sidewalks on both sides of the road, drainage, lighting, signalization, landscaping, and irrigation.
During County project design, numerous City of Sunrise water utilities were found to be in direct conflict with the planned Pine Island Road improvements. Since the utilities are located within the County right-of-way, their relocation, adjustment, and disposal are the responsibility of the City. The City has requested that County include the utility work into the County’s Pine Island Road project and the County has determined that it is a mutual benefit to the residents of the County and City to perform the utility work as part of the project.
This item seeks Board approval of a Joint Participation Agreement between Broward County and the City of Sunrise to provide payment of $1,186,000 for the relocation, disposal, and adjustment of City utilities related to County’s Pine Island Road project. Under the Agreement, the City will cover all costs associated with the City utility work, including but not limited to applicable pro-rata portions of all permitting, design and 12% of the construction engineering and inspection costs of the project. The City will also provide for the ongoing and perpetual maintenance and repair of the relocated utilities, including compliance with existing Broward County Highway Construction and Engineering Division permit conditions. Moreover, the City will pay or reimburse the County for any damage to the road and project work caused by City’s maintenance and repair of the relocated utilities. Upon project completion, County will refund to the City any unspent portion of the payment after deducting the actual City costs.
The Agreement has been reviewed and approved as to form by the County Attorney’s Office and the Risk Management Division.
