Why Action is Necessary

In accordance with the Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, and authorize the execution of the associated contracts, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Provides for an open-end contract for all the necessary labor and equipment for a unidirectional flushing program for the Port Everglades Department.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE PORT EVERGLADES DEPARTMENT/SEAPORT ENGINEERING AND CONSTRUCTION DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

The Office of Economic and Small Business Development (OESBD) designated this solicitation reserved for certified Small Business Enterprises (SBE). Madsen/Barr Corporation is a certified SBE firm, which has been reviewed and approved by OESBD (Exhibit 2).

 

The purpose of this contract is to provide all the necessary labor and equipment for a unidirectional flushing program for the Port Everglades Department. The initial contract period begins on the date of award and terminates one year from that date.

 

The Director of Purchasing determined that the apparent low bidder, Pure Technologies U.S. Inc. dba Wachs Water Services, to be non-responsive for failure to comply with the requirements of the SBE Reserve (Exhibit 2).

 

The Port Everglades Department reviewed the bid submitted by the recommended bidder, Madsen/Barr Corporation, and concurs with the recommendation for award (Exhibit 3). Three performance evaluations have been completed for Madsen/Barr Corporation within the past five years; the firm has an overall rating of 3.93 out of a possible 5. Copies of Madsen/Barr Corporation vendor performance evaluations are available upon request.

 

The Purchasing Division has reviewed the price submitted by the recommended bidder, Madsen/Barr Corporation, and determined that the price submitted is fair and reasonable when compared to the apparent low bidder, Pure Technologies U.S. Inc. dba Wachs Water Services, the previous contract, and the Consumer Price Index (CPI), which reflects increases of 26.01% and 20.63% respectively (Exhibit 4). Madsen/Barr Corporation declined to offer a voluntary price reduction.

 

The bid was posted on January 20, 2023 and opened on February 6, 2023; three bids were received with zero declination (Exhibit 1).

 

The Recommendation for Award was posted on the Purchasing Division website from April 21 - 27, 2023. There was no protest or appeal filed against this procurement.
