Why Action is Necessary

Board of County Commissioners' approval is required to declare as and dispose of surplus property pursuant to Florida Statutes, Section 125.35(2) and Broward County Administrative Code, Section 6.122.

 

What Action Accomplishes

Declares two parcels of real property surplus to the County’s needs and provides for the disposal of unused surplus real property resulting in the elimination of potential liability and maintenance costs.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

Broward County (“County”) is the owner of two contiguous parcels of real property comprised of an approximately 4,472 square feet vacant parcel identified by Folio Number 4942-10-00-0083 (“Parcel 1”), and an approximately 826 square feet vacant parcel identified by Folio Number 4942-10-13-0012 (“Parcel 2”, and together with Parcel 1, “Parcels”), and located between East Cypress Creek Road and West McNab Road in the City of Fort Lauderdale.  The Broward County Property Appraiser currently assesses the just/market value for Parcel 1 at $2,280, and Parcel 2 at $420.  The Parcels are designated “Vacant Governmental” by the Broward County Property Appraiser, and zoned “B-3 Heavy Commercial/Light Industrial Business” under the City of Fort Lauderdale’s zoning codes.  The Parcels are not suitable for development, are deemed unbuildable and are of use to only one or more adjacent property owners due to their size, shape, location, and value.

 

The County acquired Parcel 1 by Miscellaneous Map recorded on September 24, 1982, in Miscellaneous Maps Book 6, Page 35, and Parcel 2 by Warranty Deed recorded on February 1, 1979, in Official Records Book 8019, Page 278, all of the Official Records of Broward County, Florida.

 

The Parcels will be sold together to the same purchaser.  The Parcels include water and wastewater installations and drainage facilities.  The County will require that the purchaser of the Parcels grant to the County, simultaneously at the time of closing of the sale, easements for water, sewer, and drainage purposes.

 

All applicable Broward County agencies were solicited for the potential County sale of the Parcels and there was no objection to the sale.

 

Pursuant to Florida Statutes, Section 125.35(2), "…when the board of county commissioners finds that the value of a parcel of real property is $15,000 or less, as determined by a fee appraiser designated by the board or as determined by the county property appraiser, and when, due to the size, shape, location, and value of the parcel, it is determined by the board that the parcel is of use only to one or more adjacent property owners, the board may effect a private sale of the parcel.  The board may, after sending notice of its intended action to owners of adjacent property by certified mail, effect a sale and conveyance of the parcel at private sale without receiving bids or publishing notice; however, if, within 10 working days after receiving such mailed notice, two or more owners of adjacent property notify the board of their desire to purchase the parcel, the board shall accept sealed bids for the parcel from such property owners and may convey such parcel to the highest bidder or may reject all offers.”
