Why Action is Necessary

A. Broward County Board of County Commissioners (“Commission”) adoption of this Resolution is required for appropriation and disbursement of grant funds for agreements with external agencies and to authorize the County Administrator to execute the agreements.

B. Section 129.06(2)(d), Florida Statutes, requires a budget resolution to recognize revenue.

C. Commission adoption of this Resolution is required to create two new positions to support the work of the Homeless Continuum of Care.

D. A waiver of conflict arising under Section 112.313(7)(a), Florida Statutes, requires two-thirds approval by the Commission.

What Action Accomplishes

Adoption of Motions A, B, and C provides funding for two (2) new staff positions and continued funding for supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.

Approval of Motion D waives the existence of any conflicts arising under Section 112.313(7)(a), Florida Statutes, as authorized under applicable law.

Summary Explanation/Background

THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” Funding supports two (2) new staff positions, the provision of supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.

On August 22, 2023 (Item No. 15), the Commission approved the submission of the Broward County grant application to HUD to continue funding for the existing continuum of care projects for the provision of supportive services, housing, and rental assistance for individuals and families in Broward County who are experiencing homelessness, in addition to providing for operational and administrative expenses.

Commission approval is requested for appropriation and disbursement of HUD grant funds to specified service providers (Exhibit 1, Attachment A). Broward County is responsible for providing a HUD-required match for all projects listed on Attachments A and B (Exhibit 1, Attachments A and B).

New agreements with the service providers identified with an “N” in Exhibit 1, Attachment A, will be in substantially the same form as the applicable standard form agreement previously approved by the Commission.  Existing agreements with the service providers identified with an “R” in Exhibit 1, Attachment A, will be renewed in accordance with the terms and conditions of the agreements.

The Office of the County Attorney will review and approve as to form the agreements with the specified service providers prior to execution by the County Administrator.

Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is… doing business with an agency of which he or she is an officer or employee.” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes.  An effective waiver requires a two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion D) in accordance with Section 112.313(12), Florida Statutes.  Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached to this report as Exhibit 3 and constitute full disclosure of any existing conflicts.
