Summary Explanation/Background
This item is related to the proposed Broward Property Assessed Clean Energy (“PACE”) Ordinance being considered by the Board on October 8, 2024. If enacted, that Ordinance would require PACE program administrators to execute an interlocal agreement (“ILA”) with the County as a condition to offering PACE financing in Broward County (municipalities could create different conditions to the offering of PACE financing within their municipality). This requirement is consistent with the 2024 legislative amendments to the Florida PACE statute.
This item was originally scheduled to be considered by the Board on June 18, 2024. At that meeting, the Office of the County Attorney (“CAO”) informed the Board that CAO lawyers and Resilient Environment Department (“RED”) staff would meet with industry stakeholders to discuss their respective concerns. Several meetings took place, and the proposed ILA (attached as Exhibit 1) was revised to address comments from industry stakeholders and the County Auditor’s Office. Some open issues remain, which we will address in agenda briefings. We will continue to attempt to achieve resolution on the open issues between agenda print and October 8, 2024.
This item was scheduled to be considered by the Board on August 22, 2024, but was continued until October 8, 2024, to allow additional time to address open issues.
This item, if approved, would authorize the County Administrator to approve nonmaterial changes to the ILAs and execute the final ILAs, subject to CAO review and approval as to legal sufficiency.
