What Action Accomplishes
Allows for the consideration of the First Amendment to Lease Agreement between Broward County and Florida Fish and Wildlife Conservation Commission, an agency of the State of Florida. This is the first of two Public Hearings. The second Public Hearing will be held on May 12, 2026. No action is required on this motion.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
The Florida Fish and Wildlife Conservation Commission (“FWC”) maintains a law enforcement facility at Port Everglades that includes office and warehouse space, outside boat storage, and floating docks for FWC boats. The facility was on state-owned land until its purchase by the County in 2014. On April 12, 2016 (Item No. 6-PH), the Board approved a Lease Agreement Between Broward County and the FWC (“Agreement”) for an 11,585 square foot building with related improvements, located on 2.3 acres of land at Port Everglades, with a term ending December 31, 2028.
Pursuant to Section 32.6(d) of the Broward County Administrative Code, rent was waived because the premises are used for governmental purposes. FWC’s marine law enforcement activities conducted from this location support operations at Port Everglades and throughout Broward County. The Agreement allows FWC, at its discretion, to sublease a portion of the premises to the Broward Sheriff’s Office (“BSO”) for use by its marine patrol unit; however, FWC may not charge BSO rent for any such subleased space.
FWC has requested an extension of the Agreement’s term to undertake capital and cosmetic improvements to the facility, including roof repairs. The proposed First Amendment to the Lease Agreement would extend the term through December 31, 2035, update provisions related to improvements, and amend certain miscellaneous provisions.
The Notice of Public Hearing was published twice (April 17, 2026, and April 24, 2026). Notice for the second public hearing on May 12, 2026, will be published twice prior to that hearing (May 1, 2026, and May 8, 2026), pursuant to the applicable provisions of Chapter 94-429, Laws of Florida.
The First Amendment to the Lease Agreement has been reviewed and approved as to form by the Office of the County Attorney.
