Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

On August 11, 2015, the County entered into a Revocable License Agreement with the Legacy Donor Services Foundation (“Foundation”) for the use of approximately 515 square feet of office space at the Office of the Medical Examiner and Trauma Services (“Agreement”).

On May 5, 2020, the parties entered a first amendment to the Agreement to account for the reduction and reinstatement of the licensed area because of the Covid-19 Pandemic. As a result of the pandemic, the County required the use of approximately 407 square feet of the licensed area which decreased the total licensed area to approximately 108 square feet and reduced monthly compensation to the County to $68.25.

The County is no longer using that space and it has been returned to the Foundation for their occupancy and use effective August 1, 2024, along with the monthly compensation which has been reinstated to $325.

This Second Amendment to the Revocable License Agreement will extend the term of the Agreement for five years beginning August 1, 2024, and terminating July 31, 2029, provide for additional renewal options for up to two successive period(s) of five years each, provide for the optional reduction and reinstatement of the licensed area, and clarify the terms regarding the authorized use of the licensed area.

The Second Amendment has been reviewed and approved as to legal sufficiency by the Office of the County Attorney.
