Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/HIGHWAY CONSTRUCTION AND ENGINEERING DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

On August 22, 2023 (Item No. 86), the Board of County Commissioners approved the Interlocal Agreement between Broward County and the City of Fort Lauderdale for the design and construction of a 60-inch effluent force main running along County right-of-way and Port Everglades property (Exhibit 2). The Interlocal Agreement included a construction milestone, requiring the City to complete the portion of the project along Eisenhower Boulevard by May 16, 2025.  If construction extends beyond this date, the City is subjected to paying liquidated damages to Broward County.

On September 10, 2024, City submitted a request to extend the Eisenhower Boulevard milestone by 34 calendar days. After review and discussions with City staff, County staff determined that an extension of 23 calendar days is appropriate due to delays in relocation of a fiber optic cable owned by the County and power transmission lines owned by FPL.  This would change the milestone from May 16, 2025 to June 8, 2025.

This Motion seeks Board approval of the First Amendment to the Interlocal Agreemement between Broward County and the City of Fort Lauderdale extending the construction completion date from May 16, 2025 to June 8, 2025 (Exhibit 1). Granting the time extension of 23 calendar days will not impact the schedules of the Convention Center Expansion, Convention Center Hotel, the By-Pass Road, or the ancillary parking garage. This motion is contingent upon receipt of the approved and executed First Amendment from the City of Fort Lauderdale prior to 5 P.M. on Friday, May 9, 2025. The City Commission is scheduled to approve the First Amendment at its May 6, 2025, City Commission Meeting. Also, this Motion seeks Board authorization for the Director of Public Works Department to approve and execute amendments to the Interlocal Agreement for time extensions without impacting County project schedules and adding financial risk on the County, subject to review by the County Attorney’s Office. The delegation will facilitate approval of time extension amendments to the Interlocal Agreement thus ensuring timely completion of project construction.

The First Amendment has been reviewed and approved as to form by the County Attorney’s Office.
