Title: MOTION TO APPROVE Access Agreements between the City of Dania Beach, the City of Hollywood, the City of Hallandale Beach and Broward County in substantially the form of Exhibit 1 to allow temporary access onto the beach and temporary staging of equipment on city property for work necessary for the Broward County Shore Protection Project Segment III ("Project") and required by Florida Department of Environmental Protection ("FDEP") permits; authorize the County Administrator to negotiate and approve changes to the form agreement that do not impose any additional cost or material additional risk to the County, subject to review and approval for legal sufficiency by the County Attorney's Office, and to execute same; and authorize the County Administrator, subject to review and approval for legal sufficiency by the County Attorney's Office, to execute amendments to the Agreements that do not impose additional financial obligations on the County. Why Action is Necessary

Broward County Board of County Commissioners approval is required to execute access agreements with local governments.

 

What Action Accomplishes

This action grants Broward County and its agents the authority to conduct work on specific portions of the beach and use designated access points and staging locations for passage onto the beach and storage of equipment for beach management activities in support of the Project.

Summary Explanation/Background

The Public Works and Environmental Services Department Recommends Approval of the Above Motion.

 

This item supports the County Commission’s Goal of Resilient Community of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

Located along the southern portion of the Broward County shoreline, between Port Everglades Inlet and the Broward County/Miami-Dade County line, this Project is 8.1 miles in length and fronts Dr. Von D. Mizell-Eula Johnson State Park as well as the cities of Dania Beach, Hollywood, and Hallandale Beach.

 

The FDEP permit for this Project includes, but is not limited to, periodic sand placement, dune construction, beach tilling, and escarpment removal. Access Agreements are necessary to allow access onto the beach and staging of construction equipment to conduct permitted activities.

 

The Cities of Hollywood, Hallandale Beach, and Dania Beach considered the Access Agreements at their October 9, October 22, and October 28 meetings, respectively. The County has not yet received the executed Access Agreements. Staff will advise the Board of County Commissioners (“Board”) if the County has not received the Access Agreements by the Board’s November 13th meeting.

 

The proposed form Access Agreement includes a right to terminate by either Party with at least 30 calendar days advance written notice. This item would authorize the County Administrator to negotiate and approve the final form of the agreements, provided that the changes do not impose any additional cost or material additional risk to the County, and subject to review and approval for legal sufficiency by the County Attorney’s Office.

There is no fiscal impact associated with approval of this item. Funds for Project activities are included in the beach program’s portion of the board-approved capital budget and are also eligible for partial state and federal reimbursement.
