Summary Explanation/Background

THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTIONS.

Motion A

This action appropriates funds within the HWO Capital Fund to accept the FDOT grant in the amount of $17,500 and appropriates funds for the corresponding County match in the amount of $17,500, for a total of $35,000.

Motion B

This action allows BCAD to accept grant funding from FDOT for the design of the Project at HWO.

The total design cost for the Project is estimated to be $600,000 (“Design Cost”). As outlined in the PTGA, FDOT will provide grant funding for 5% of the Design Cost, estimated to be $30,000. BCAD anticipates that the Federal Aviation Administration (“FAA”) will provide grant funding for 90% of the total Design Cost, estimated to be $540,000, and the County will fund the remaining 5% of the Design Cost, estimated to be $30,000, and will cover any Project Cost overruns.

Taxiway M is parallel to and north of Runway 10R-28L at HWO and is approximately 35 feet wide by 3,250 feet long. The proposed Project is required for the design of pavement rehabilitation of the taxiway, as well as re-alignment of the taxiway connectors M1 and M3 to meet current FAA design criteria as recommended in the Airport Layout Plan.

Based on the 2022 FDOT Statewide Airfield Pavement Management Program (“SAPMP”), the Pavement Condition Index (“PCI”) for Taxiway M is 63 (Fair) on the PCI scale. The minimum PCI service level for taxiways is 70. The FDOT SAPMP indicates that Taxiway M is already below this level and in need of rehabilitation. The pavement overlay of Taxiway M will enhance airfield overall safety and operations at HWO by improving the airfield pavement and re-aligning the connectors to current FAA design standards.

The Office of the County Attorney requested FDOT make certain modifications to a pass-through indemnification provision in the PTGA, but FDOT declined contending that the indemnification provision is legally sufficient. BCAD desires to move forward with this PTGA to obtain grant funding for the Project. The Office of the County Attorney will work with BCAD to modify the relevant third-party construction or design agreements, as applicable, to comply with the PTGA and mitigate any potential risk associated with the pass-through indemnification provision in the PTGA.

The proposed PTGA has been reviewed by the Office of the County Attorney. The PTGA does not include the County's standard Agreement provisions as FDOT requires the County to use its form agreement.
