Why Action is Necessary
Section 2-40(a) of the Broward County Code of Ordinances requires that the Broward County Board of County Commissioners (“Board”) authorize any commercial activities or occupation of any portion of the Fort Lauderdale-Hollywood International Airport (“FLL”) for any purpose unless specifically authorized by Broward County (“County”).
What Action Accomplishes
Approves the Terminal Building Lease Agreement between County and WestJet to lease and use space in Terminal 2, in accordance with the provisions of the Terminal Building Lease Agreement, which establishes the payment of rent for the leased space at FLL.

Summary Explanation/Background
THE AVIATION DEPARTMENT RECOMMENDS APPROVAL OF THE ABOVE MOTION.
This action approves the Terminal Building Lease Agreement (“TBLA”) between County and WestJet for the lease and use of airline ticket office space in Terminal 2 (“T2”) at FLL.
On October 6, 2020 (Item No. 2), the Board approved a TBLA between County and WestJet to lease and use 218 square feet of airline ticket office space in Terminal 1 (“T1”) to provide airline service. The current TBLA expires on November 16, 2025.
On August 9, 2023, WestJet relocated from T1 to airline ticket office space in T2 at the request of the Broward County Aviation Department (“BCAD”). The proposed TBLA allows WestJet to continue to lease and use 253 square feet of airline ticket office space in T2 at FLL.
The term of the TBLA shall commence on November 17, 2025, and terminate on November 16, 2030. WestJet’s payments will be based on the actual amount payable under the proposed TBLA and will be adjusted according to the rates and charges established in Chapter 39 of the Broward County Administrative Code (“Administrative Code”).
The proposed TBLA has been reviewed and approved as to form by the Office of the County Attorney and the Risk Management Division.
