Summary Explanation/Background

At its meeting of November 4, 2021 (Item No. 45), the Broward County Board of County Commissioners ("Board") created an Office of Film, and established incentive programs for film, television, and entertainment production projects ("Incentive Programs") to encourage production companies to bring their activities to Broward County. At its meeting of January 24, 2023 (Item No. 13), the Board also approved a Special Projects Incentive Program for large film and television productions with individual awards up to $5,000,000.

 

Based upon the implementation of the Incentive Programs over the last two years, the Film Commissioner recommends increasing the execution authority of the County Administrator for Incentive Programs other than the Special Projects Incentive Program. Currently, for Incentive Programs other than the Special Projects Incentive Program, the County Administrator's execution authority is limited to $100,000 and any award above that amount requires Board approval; however, many of these Incentive Programs have potential award amounts greater than $100,000. The Film Commissioner recommends increasing the County Administrator's execution authority to $500,000 for these Incentive Programs. This change would not affect the County Administrator's $5,000,000 execution authority for the Special Projects Incentive Program.

 

The proposed Resolution would codify a $5,000,000 maximum individual award amount for any Incentive Program (in lieu of the current requirement that the Board establish the maximum award per Incentive Program each year) and the ability of the Film Commissioner to modify from time to time the specific Incentive Programs offered, as determined to be in the County's best interest by the Film Commissioner and approved by the County Administrator.
