Previous Action Taken

The First Amendment to the Easement Agreement between Water Control District No. 2 and FDOT was dated May 9th, 2024 (County Agenda Item 24-446). This first amendment added area to the existing easement.

Summary Explanation/Background

PUBLIC WORKS DEPARTMENT/WATER MANAGEMENT DIVISION RECOMMENDS APPROVAL OF THE ABOVE MOTION.

The Florida Department of Transportation (FDOT) is undertaking a major construction project that includes the widening of SW 10th Street from Interstate 95 west to the Sawgrass Expressway. As part of this project, FDOT will modify and reconstruct drainage facilities adjacent to Interstate 95 in the C-1 Canal. The proposed second amendment will incorporate the maintenance of these newly installed and modified outfall and drainage features into the existing easement agreement.

Water Control District No. 2 and FDOT have an existing easement agreement originally signed on August 15, 1974, which grants the Water Control District No. 2 a perpetual easement and right-of-way for the purpose of clearing, excavating, constructing, and maintaining outfall and drainage ditches adjacent to the C-1 canal. The easement was previously amended on May 9, 2024, to expand the easement area to include FDOT’s newly dedicated land and to ensure the Water Control District No. 2’s continued access to and maintenance of the C-1 Canal and associated facilities for water management purposes.

Acceptance of this Second Amendment to the easement agreement supports the Water Control District No. 2’s water management objectives and is in the best interest of the District and the County.

All documents have been reviewed and approved as to form by the Office of the County Attorney.
