Pursuant to Section 32.10 of the Broward County Administrative Code (“Administrative Code”), to waive the competitive selection requirements set forth in Section 32.4.h of the Administrative Code, the Broward County Board of County Commissioners (“Board”) must find that good cause exists.

Summary Explanation/Background
THE PORT EVERGLADES DEPARTMENT RECOMMENDS APPROVAL.
This action supports the Broward County Board of County Commissioners’ (“Board”) Value of “Building partnerships and working collaboratively with others to meet shared objectives,” and the Goal of “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
H.T. Shipping has operated a 6.97-acre marine terminal in the Midport area of Port Everglades since 1995 (see Exhibit 1). On May 10, 2011 (Item No. 1-PH), the Board approved H.T. Shipping’s most recent Marine Terminal Lease and Operating Agreement, which established a 10-year term commencing on July 1, 2011, with one five-year renewal option. On January 26, 2021 (Item No. 5), the Board approved the First Amendment, implementing the five-year renewal option and extending the agreement through June 30, 2026.
Section 32.4.h of the Administrative Code requires a competitive selection process for Marine Terminal Lease and Operating Agreements. However, Section 32.10 of the Administrative Code authorizes the Board to waive the requirements for good cause.
H.T. Shipping remains one of the most efficient and productive marine terminals at Port Everglades. Over the past ten fiscal years, H.T. Shipping has handled more than 3.13 million short tons of cargo, generating approximately $39 million in revenue for Port Everglades. In Fiscal Year 2025 alone, H.T. Shipping handled 321,011 short tons of cargo.
Based on H.T. Shipping’s longstanding operational history at Port Everglades, its demonstrated performance, and the revenue generated for the Port, staff recommends that the Board find good cause to waive the competitive selection requirements.
This motion only waives the competitive selection requirements. The proposed Marine Terminal Lease and Operating Agreement will be considered through two required public hearings, the first of which is a separate Public Hearing item on today’s agenda.

There is no fiscal impact associated with this action. However, the total guaranteed revenue under the proposed agreement is estimated at $11,701,557, including land rent and minimum annual guaranteed (“MAG”) payments. Any throughput exceeding the MAG will generate additional revenue.
