AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE SALE OF APPOINTMENTS FOR CERTAIN PUBLIC SERVICES; CREATING SECTION 21-5 AND AMENDING SECTION 8½-16 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
Some residents of Broward County have been experiencing extraordinary delays when seeking an appointment with the Florida Department of Highway Safety and Motor Vehicles (“DMV”), with appointments often unavailable for months in advance. As advised by the Broward County Tax Collector during the Board’s meeting of April 22, 2025, part of the delay results from scalpers reserving multiple appointments on the DMV website and then selling the appointments to residents, sometimes for hundreds of dollars.
This Ordinance, if enacted, would prohibit the unauthorized advertisement, marketing, and sale of appointments for public services offered by the DMV or by the Broward County Tax Collector, with penalties of $250 for the first violation and $500 for each repeat violation.
In lieu of the customary initial agenda item to set the matter for public hearing, this item is presented directly for public hearing before the Board given the significant impact the continuation of this practice would have on the residents of Broward County, particularly on those with upcoming travel plans that necessitate a public services appointment to obtain a “Real ID-compliant” driver license. Timely notice has been published in accordance with statutory requirements to permit the Board’s consideration.
