MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on April 22, 2025, at 10:00 a.m., in Room 422 of Governmental Center East to consider adoption of a proposed Resolution Amending the Broward County Administrative Code, the title of which is as follows:
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO ORGANIZATION AND RESPONSIBILITIES OF THE PUBLIC WORKS DEPARTMENT; AMENDING VARIOUS SECTIONS OF CHAPTER 6 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”) REGARDING ORGANIZATIONAL CHANGES IN THE PUBLIC WORKS DEPARTMENT; AMENDING SECTION 25.93 AND SECTIONS 25.122 THROUGH 25.126 OF THE ADMINISTRATIVE CODE REGARDING LANDSCAPING IN SWALES IN THE PUBLIC RIGHT-OF-WAY AND THE GREEN BUILDING POLICY; REPEALING PARTS XIV, XV, XVI, XVII, XVIII, XX, AND XXI OF CHAPTER 6, INCLUDING SECTIONS 6.67 THROUGH 6.88 AND SECTIONS 6.97 THROUGH 6.103, PART X OF CHAPTER 25, AND SECTION 25.67 OF THE ADMINISTRATIVE CODE; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

The Broward County Charter requires the posting of notice and a public hearing for adoption of amendments to the Broward County Administrative Code.

Enables the setting of a public hearing during which the Board of County Commissioners (“Board”) may consider adopting the proposed Resolution Amending the Broward County Administrative Code.

Summary Explanation/Background
The proposed Resolution amends various provisions of the Broward County Administrative Code (“Administrative Code”) pertaining to the Broward County Public Works Department (“Department”), which oversees road construction and maintenance, drinking water and sewer service, and solid waste management, among other services.
The proposed amendments generally update the Administrative Code to be consistent with the current operations of the Department and to repeal obsolete or redundant provisions, including the following material changes:
1. Update provisions regarding the structure and responsibility of the Department Director and Divisions to reflect current structure and operations;
2. Authorize the Real Property and Real Estate Development Director to execute certain documents pertaining to approved real estate transactions (e.g., estoppel certificates), trespass affidavits, telecommunications and utilities access agreements, and agreements to permit temporary use or access (not to exceed six months) of County property for specified purposes (limited to real property management or governmental/public safety purposes);
3. Provide that any landscaping within the swale portions of public rights-of-way must comply with the applicable zoning requirements and be maintained by the individual homeowner or homeowners’ association, as applicable; and
4. Amend the Green Building Policy to reflect changes in the Leadership in Energy and Environmental Design Rating System (“LEED”) by the U.S. Green Building Council.
The codified delegations of authority regarding real estate transactions referenced above would supersede prior, uncodified general delegations of related authorities.
