MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on November 10, 2026, at 10:00 a.m., in Room 422 of Governmental Center East to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO THE BROWARD COUNTY BUSINESS OPPORTUNITY ACT AND RELATING TO COUNTY BUSINESS ENTERPRISE (“CBE”) RESERVE PROCUREMENTS; AMENDING SECTION 1-81.3 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”) TO MODIFY REQUIREMENTS APPLICABLE TO QUALIFIED VENDOR LISTS ESTABLISHED AS CBE RESERVES; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Applicable law requires the publication of notice and a public hearing for enactment of amendments to the Broward County Code of Ordinances (“Code”).

Summary Explanation/Background
This item supports the Commission’s Goal: “Ensuring economic opportunities and a sustainable economy, with an emphasis on Broward’s lower and middle class.”
The County’s Business Opportunity Act includes the County Business Enterprise (“CBE”) reserve program, which is intended to create opportunities for certified CBEs to serve as prime contractors on County contracts. Under the current program, although both CBEs and nonCBEs may respond to CBE reserve procurements, a CBE would receive the award if its bid or proposal satisfies the applicable monetary differential and, where applicable, points differential. These differentials compare the CBE’s price and/or evaluation points to those of the most competitive nonCBE.
The proposed Ordinance establishes specific procedures for quotation requests issued under Qualified Vendor Lists (“QVLs”) established as CBE reserves, including requirements governing placement of vendors on the QVL and awards made under individual quotation requests. If the Ordinance is enacted, all responsive and responsible vendors will be placed on the CBE reserve QVL unless otherwise stated in the applicable solicitation. For each quotation request issued under a CBE reserve QVL, if three or more responsive and responsible CBEs submit quotes, the award will be made to the CBE that submits the lowest responsive and responsible quote, provided its proposed pricing is determined to be fair and reasonable. If the CBE’s pricing is not fair and reasonable, the award will be made to the nonCBE with the lowest responsive and responsible quote, provided the nonCBE’s pricing is determined to be fair and reasonable. If the Director of Purchasing determines that no award should be made, the Director of Purchasing will reject all quotes and reissue the quotation request or may proceed as otherwise permitted by the Procurement Code. If fewer than three responsive and responsible CBEs submit quotes, the existing monetary differential will continue to apply to the quotes submitted by CBEs and nonCBEs.
