Summary Explanation/Background
On October 7, 1997, Broward County conveyed to the Collier City/Pompano Beach Community Development Corporation, Inc., a nonprofit corporation (“Grantee”), real property located at 3001 N.W. 8th Street, Pompano Beach, Florida 33069 (the “Property”). The conveyance was made on the express condition set forth in the Quitclaim Deed that title to the Property reverts to and vests in the County immediately and automatically upon the occurrence of any of the following:
1. Grantee, its successors or assigns, cease to be a nonprofit organization/corporation under the Internal Revenue Code and applicable state law;
2. Grantee, its successors and assigns, conveys the Property to another person or entity or makes an unauthorized sale of the Property;
3. The Property is not used, at all times, to promote the public and community interest and welfare;
4. Grantee sells, transfers, conveys or otherwise disposes of the Property to any other person or entity, without the prior express approval of the County;
5. Grantee fails to keep the Property well maintained, in compliance with local codes and laws and adequately insured; or
6. The Property is mortgaged or encumbered.
Grantee no longer uses the Property, which is vacant and in disrepair. Grantee has not paid property taxes since 2019 (as of September 1, 2024, the total amount of delinquent property taxes is $64,257.40). In addition, the Property is encumbered by an Order of Imposition of Fine and Claim of Lien recorded on January 12, 2024, as Instrument #119333177, in the Official Records of Broward County, Florida, imposing fines and claims of lien for violations of certain sections of the City of Pompano Beach Code of Ordinances (as of July 22, 2024, the total amount of fines is $175,780.00). The foregoing events triggered the reverter clause in the Quitclaim Deed and Grantee requested that the County take back the Property.
The Resolution (attached as Exhibit 1) accepts the Quitclaim Deed from The Collier City/Pompano Beach Community Development Inc., a Florida not for profit corporation, conveying to Broward County, the real property, located at 3001 N.W. 8th Street, Pompano Beach, Florida 33069.
