B. MOTION TO APPROVE contract award to ICF Incorporated, L.L.C, for consultant assistance with the development and implementation and technical assistance related to  the programmatic portion of the Action Plan and Technical Assistance (“TA”), as necessary and outlined in the Request for Applications for the Community Development Block Grant Disaster Recovery (“CDBG-DR”) grant funds, in amounts not to exceed the fees proposed at $90,094 (Exhibit 2); to authorize County Administrator to execute the contract documents with ICF Incorporated L.L.C., for said services, and any amendments that do not impose additional financial obligations on the County, subject to review and approval for legal sufficiency by the Office of the County Attorney; and to authorize the County Administrator to take all necessary administrative and budgetary actions for implementation.

C. MOTION TO APPROVE HOME Investment Partnership American Rescue Plan Grant (“HOME-ARP”) funding as detailed in Exhibit 3, for three affordable housing projects as follows: 1) Sistrunk Apartments, LLC or its affiliate/Sistrunk Apartments, a maximum of $1,500,000 (72 total units, a minimum of nine HOME-ARP designated units); 2) Hollywood Vista, a maximum of $1,000,000 (118 total units, a minimum of six HOME-ARP designated units); and 3) The Pantry Lofts, LTD/Greenmills Holdings, a maximum of $1,500,000 (100 total units, a minimum of nine HOME-ARP designated units); authorizing the County Administrator to execute all agreements related to the projects, subject to the foregoing monetary limits and approval as to legal sufficiency by the Office of the County Attorney; and authorizing the County Administrator to take the necessary administrative and budgetary actions. Why Action is Necessary

Motion A

Board approval is required to amend Broward County HUD Five Year Strategic Consolidated Plans and accompanying Annual Action Plans to reprogram/reallocate funding and priorities, implement substantial changes, execute agreements and amendments to implement such changes, and subsequently execute agreements with other municipalities, agencies, and vendors.

 

Motion B

What Action Accomplishes

Motion A

Approves changes to the Broward County HUD Five Year Strategic Consolidated Plans and accompanying Annual Action Plans, appropriates funds to agreements with other municipalities, agencies and vendors, and subsequent budgetary and administrative actions.

 

Motion B

Approves award and preparation of agreement/Purchase Order with ICF, to provide all labor, materials, data, and services required for the tasks necessary as outlined in the RFA (Exhibit 2) for the CDBG-DR Action Plan and TA services.

 

Motion C

Allows the County Administrator to execute agreements for additional GAP financing three affordable housing projects generally located in the areas depicted in Exhibit 4. Please note that one of the projects is on two split lots so there are four locations depicted on the map for three projects.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE HOUSING FINANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.

 

This item supports the Board's value: "Ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated, permanent supportive housing and zoning that helps residents build equity”.

 

Motion A

This motion allows the County to make the necessary changes to the Broward County HUD Five Year Strategic Consolidated Plans and accompanying Annual Action Plans (AAP), make necessary regulatory, project eligibility and programmatic changes, and subsequent budgetary and administrative actions detailed in Exhibit 1.

Motion B

HUD Requires that grantees awarded CDBG-DR funds, through a process for identifying and prioritizing critical unmet needs, provide analysis of the disaster impact and the resulting needs that have not been addressed through other funding sources (unmet needs) and conduct outreach and public participation/comment. This is done by submitting a CDBG-DR Action Plan that addresses the CDBG-DR funds. The Deadline for the Action Plan was originally March 16, 2025.

 

On March 6, 2025, the Housing Finance Division (HFD) requested an extension of the deadline to submit the CDBG-DR programmatic portion of the Action Plan to HUD. HUD Approved the extension request on March 13, 2025. The programmatic portion of the Action Plan must now be submitted by August 15, 2025.

 

The HFD completed the administrative portion of the Action Plan, approved by the Broward County Board of County Commissioners (“BOCC”) at its April 1, 2025 meeting, which will allow the HFD to incur and qualify for the reimbursement of general administrative costs, including carrying charges, such as grant management and overhead costs directly related to the implementation of the CDBG-DR funds.

 

Due to the short timeline and complexity of the CDBG-DR grant requirements, the HFD solicited consulting services to assist with the preparation of the programmatic portion of the Action Plan.

 

Subsequently, on February 26, 2025, the HFD issued the RFA in order to obtain assistance with the preparation and completion of various tasks, data and needs assessments and outreach mechanisms for the completion of the Broward County programmatic portion of the Action Plan addressing the CDBG-DR funds.

 

The applications to the RFAs were due on March 14, 2025. ICF Incorporated, L.L.C.  was the only respondent and was determined to be responsive and responsible and met all the required criteria for the RFA. The RFA requested that the applicants submit alternate costs for additional data information, mapping, meetings and/or unexpected circumstances. The HFD has performed a cost reasonableness analysis and researched the quotes/fees submitted by the recommended bidder, ICF Incorporated, L.L.C, and has determined that the prices submitted are fair, reasonable, and aligned with market analysis for the industry.

 

After Board approval, an agreement or purchase order between Broward County and ICF Incorporated, L.L.C, and other related documents, will be drafted. The terms will include payment by Broward County to ICF, in an amount not to exceed the total costs per task as outlined in Exhibit 2.

Between November 9, 2021, and March 10, 2023, the HFD issued several RFAs soliciting affordable housing organizations to utilize “gap” financing for the new construction or acquisition and rehabilitation of multi-family affordable housing rental units utilizing Affordable Housing Trust Fund (“AHTF”) and/or Land Use Mitigation Account (“LUMA”) and HFA bonds.

 

The projects listed below were selected and awarded by the BOCC. 

 

On February 22, 2022, Agenda Item 22-133, the BOCC approved $2,000,000 in funding for The Pantry Lofts.

On June 6, 2023, Agenda Item 23-780, the BOCC approved $3,960,000 in funding for Sistrunk Apartments, LLC.

On June 18, 2024, Agenda Item 24-572, the BOCC approved $6,490,000 funding for Hollywood Vista.

 

Due to the rise in costs associated with construction labor and materials, as well as long- term maintenance and preservation costs, the developments listed above and detailed in Exhibit 3 are requesting additional funding. To address these three project funding deficits, the HFD is proposing to utilize remaining balances from a HOME-ARP grant as detailed on Exhibit 3.

 

All projects are required to receive full and individual credit underwriting and servicing.  Underwriting and servicing firms are selected based on sources of equity and may include HFA or Florida Housing Finance Corporation (“FHFC”) underwriters and servicers as determine by County staff or FHFC staff.  The HFD staff will conduct the federal underwriting and regulatory requirements. All funding is dependent upon underwriting, gap funding needs, and funding availability.     

 

The terms of the loan agreements will include a minimum term of 50 years for the affordable housing land use restriction, a 0% interest rate loan with a minimum term of 30 years, and the loan becomes payable on the maturity date, or upon sale, change of title, or refinancing, whichever occurs first.
