Summary Explanation/Background

On August 25, 2022, the Board of County Commissioners (“Board”) directed the County Attorney’s Office (“CAO”) to prepare Ordinances to amend or repeal outdated or obsolete provisions of the Broward County Code of Ordinances (“Code”). Board direction is not required to prepare similar amendments to the Broward County Administrative Code (“Administrative Code”). As the ordinance project moves toward completion, the CAO is now addressing similar issues with the Administrative Code and will be presenting various Resolutions for Board consideration.

The proposed Resolution addresses certain legacy references in the Administrative Code to outdated programs and policies:

Sections 19.9 through 19.11, regarding grant-in-aid programs to nonprofit organizations, contain outdated requirements, such as limiting grants to three consecutive years and requiring audited financial statements for awards of more than $5,000, which are no longer reflective of County policies.

Sections 19.41 through 19.45 and Sections 19.50 through 19.54, regarding small disadvantaged business enterprise programs for minority business enterprises and women business enterprises, are no longer applicable because those programs have been effectively replaced with County programs for County Business Enterprises and Small Business Enterprises.

Section 19.62 lists procedures for expenditures for administrative expenses, such as requiring a Board Resolution for unbudgeted expenditures over $500, which are no longer reflective of County policies and procedures.

Section 19.76, regarding first-source quid pro quo hiring agreements, is no longer applicable and has been substantially replaced with the County’s Workforce Investment Program.

Section 22.107, regarding retirement health savings accounts, is no longer reflective of County policies, and therefore should be removed from the Administrative Code.

The proposed Resolution would repeal these outdated references in the Administrative Code.
