Summary Explanation/Background

Chapter 39 of the Broward County Code of Ordinances (“Zoning Code”) is maintained digitally through the Municipal Code Corporation. However, Section 39-11 of the Zoning Code still requires staff to have paper zoning maps on file for public use. For several years zoning data had been made accessible, through the Urban Planning Division’s webpage, in an easy-to-search format for property owners and developers. The proposed Ordinance would discontinue the paper zoning maps.

Multiple sections of the Zoning Code define and regulate community residential homes and assisted living facilities. The proposed Ordinance updates these sections to be consistent with site selection requirements of Section 419.001, Florida Statutes.

Section 39-74(b) of the Zoning Code currently entitles nonconforming plots located within residential zoning districts to construct a minimum of one dwelling unit. The proposed Ordinance permits construction consistent with the applicable zoning category on nonconforming plots located within residential zoning districts.

Finally, the proposed Ordinance provides for several nonsubstantive amendments updating the Zoning Code.

The Local Planning Agency held its public hearing on February 12, 2025, and determined that the proposed Ordinance is generally consistent with the Broward County Comprehensive Plan.
