Why Action is Necessary
A. In accordance with Broward County Procurement Code Section 21.25(a), Sole Source Procurement, sole brand procurements above the award authority of the Director of Purchasing must be approved by the Board.
B. In accordance with Broward County Procurement Code Section 21.47(a), Award and Execution Authority, the Board shall make all awards, with a value of more than $500,000, inclusive of the value of any renewals or extensions provided for in the contract.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE BROWARD COUNTY OFFICE OF REGIONAL COMMUNICATIONS AND TECHNOLOGY RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the Board’s Accountable Government Goal, “Consistently delivering responsive, efficient, inclusive, and equitable quality services to the public and internal customers while providing a safe community to live, work and visit.”
The purpose of this sole brand designation for Sophos Software and of this solicitation is to secure an open-end contract for the purchase of Sophos anti-virus and ransom-ware application for Broward County that provides an additional layer of protection for the Broward County Public Safety Intranet (PSI) from malware and ransom-ware attacks while inter-operating with existing information security systems to further improve the data security posture of the PSI computing infrastructure. Sophos Software is required to provide support services as this product is currently in use in the PSI infrastructure, providing 24x7x365 phone support, online knowledge base, and product updates. This procurement seeks to upgrade Broward County’s subscription to include managed services.
This procurement is crucial to ensure that public safety operations are not compromised and that the infrastructure systems necessary to dispatch critical First Responders and to coordinate deployment of emergency services are protected.
On October 18, 2023, and subsequently on May 6, 2024 (to meet Procurement Code time limits), the Purchasing Division issued a Request for Information (RFI) notice of intent to designate sole source/sole brand to ascertain whether there were any other entities able to provide Sophos MDR Complete Security Services for Office of Regional Communications and Technology (ORCAT). The first RFI yielded two responses from Sophos authorized resellers. A third vendor responded via email offering an alternative solution: Covalence Complete. However, per ORCAT, this solution does not meet the needs of the County due to its inability to provide real-time automatic rollback of documents after encryption (increasing the recovery time), and to its lack of breach protection warranty in the event of a ransomware attack. The second RFI yielded no responses. Based on this information, the Director of Purchasing recommends approval of this sole brand request (Exhibit 1).
On December 6, 2023, the Director of Purchasing recommended the approval of a sole brand designation and authorized the solicitation to be advertised for Sophos MDR Complete Security Services.
On March 12, 2024, the Purchasing Division issued Invitation to Bid (ITB) No. TEC2128072B1 for Sophos MDR Complete Security Services. Two offers from Sophos authorized resellers were received. (Exhibit 2).
The Office of Economic and Small Business Development did not assign participation goals for this contract based on the sole brand request (Exhibit 3).
ORCAT has reviewed the offer submitted by Trebron Security, LLC and concurs with the recommendations for award (Exhibit 4).
The Purchasing Division researched the prices submitted by the low bidder, Trebron Security, LLC, and determined that the prices submitted are fair and reasonable as compared to the previous solicitation that was completed in late 2023 (Exhibit 5).
No County vendor performance evaluations have been completed for Trebron Security, LLC.
The Recommendation for Award was posted on the Purchasing Division website from May 7 - 12, 2024. There was no protest or appeal filed against this procurement.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
The resultant open-end contract will provide for the procurement of Sophos MDR Complete Security Services for a one-year initial term, commencing on November 1, 2024, in the estimated amount of $166,295, with two one-year renewal periods in the estimated annual amounts of $171,000, for a three-year estimated total project value of $508,295. The terms and conditions of the solicitation and vendor's response serve as the contract.
