A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT FEES; AMENDING VARIOUS SECTIONS OF CHAPTER 40 OF THE BROWARD COUNTY ADMINISTRATIVE CODE (“ADMINISTRATIVE CODE”) TO REVISE FEES RELATED TO THE ANIMAL CARE DIVISION AND BUILDING CODE DIVISION; CREATING SECTION 40.37 OF THE ADMINISTRATIVE CODE TO ESTABLISH A ZONING FEE SCHEDULE WITHIN THE BUILDING CODE DIVISION; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE ADMINISTRATIVE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider adoption of the Resolution Amending the Broward County Administrative Code was adopted by the Board of County Commissioners (“Commission”) at its meeting of January 22, 2026.

Summary Explanation/Background
The proposed Resolution amends various sections of Chapter 40 of the Broward County Administrative Code to revise fees related to the Animal Care Division and the Building Code Division of the Public Works and Environmental Services Department (“PWESD”) in order to:
• Clarify reclaim fees for impoundments and eliminate the waiver that allowed those fees to be waived upon proof of sterilization within thirty (30) days after the impoundment;
• Remove the Animal Care Division Director’s authority to waive rabies registration tag fees;
• Establish a pet trader permit fee and a permit reinstatement fee for breeders and pet traders;
• Add fees for failure to comply with dangerous and aggressive dog requirements;
• Create a general fee category for violations of Chapter 4 of the Broward County Code of Ordinances where no specific fee is established in the fee schedule;
• Eliminate Building Code Division fees related to microfilm prints;
• Add Building Code Division fees for: (i) Certificate of Use inspections performed by electrical, mechanical, plumbing, and structural inspectors, as required; (ii) partial releases of liens (including fees for expedited processing); and (iii) administrative and reinspection fees related to elevators, escalators, and other apparatuses;
• Create a zoning fee schedule within the Building Code Division’s fee schedule due to organizational changes within PWESD; and
• Revise the zoning fee schedule for the Housing and Urban Planning Division.
The County Attorney’s Office submitted additional material for the Commission’s consideration at the January 22, 2026, meeting to further amend the proposed Resolution to: (i) add a fee for failure to obtain a pet trader permit to Section 40.9 of the Broward County Administrative Code; and (ii) renumber the subsequent fees in that section. The Commission approved these changes, which are reflected in the proposed Resolution (Exhibit 1), beginning on line 123.

Fiscal Impact/Cost Summary
No adverse fiscal impact is anticipated by the proposed changes. The changes are expected to bring the Building Code Division fee structure closer to cost recovery and may result in a positive fiscal impact.
