Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE CONSTRUCTION MANAGEMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On April 8, 2021 (Item No. 31), the County entered into the Construction Agreement Between Managing General Contractor and Broward County, Florida with DPR Construction, A General Partnership (“DPR”) for Medical Examiner’s Office and BSO’s Crime Lab Combined Facility, No. PNC2119546P1 (“the Agreement”). The Agreement established an estimated guaranteed maximum price of $156,112,465 for the construction of a Forensic Science Center (the “Project”). Throughout the procurement process and execution of the Agreement, the Project was intended to be located at 1625 NW 23rd Avenue, Fort Lauderdale, Florida.

 

On January 11, 2024 (Item No. 54), the Board approved the purchase of a new Project site located at 2000 W. Commercial Blvd. in Fort Lauderdale. After the start of preconstruction services on the original project site, the County decided to relocate the project to the 2000 W. Commercial Blvd. site. County negotiated with DPR additional preconstruction and demolition services for the demolition of an existing building structure at the new site.

 

On September 29, 2025, after six months of fact-finding and negotiations for preconstruction services for the new site, the County and DPR reached an impasse and DPR stated that it desired to withdraw from the Project. The Public Works and Environmental Services Department and Construction Management Division recommend the mutual termination of the Agreement.

 

Pursuant to the Agreement, DPR performed certain pre-construction services both for the former site and for demolition of the structure at the new site, for a total compensation to be paid to DPR of $2,413,695 if the proposed mutual termination is approved by the Board.

 

The mutual termination letter (Exhibit 1) will be distributed as additional material prior to the Board meeting.
