MOTION TO APPROVE Second Amendment to Agreement 22-CP-HIP-8666-02 between Broward County and Broward Partnership for the Homeless, Inc., d/b/a Broward Partnership, decreasing the Agreement’s maximum funding amount by $220,000, from $540,000 to $320,000, effective October 1, 2023, to remove the program providing rapid rehousing services for individuals and families experiencing homelessness; authorize the Mayor and Clerk to execute same; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement as amended.

B. MOTION TO APPROVE waivers of conflict under Section 112.313(7)(a), Florida Statutes, for the following Broward County advisory board members holding an employment or contractual relationship with an entity receiving funds for the performance of services under this agenda item:

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
These actions support the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The Second Amendment removes Program 2, Rapid Rehousing - Individuals and Families, from the Agreement with Broward Partnership for the Homeless, Inc., d/b/a Broward Partnership (“BPHI”). This will allow the funds to be reallocated among existing service providers within the continuum of care to provide additional assistance and supportive services to individuals and families experiencing homelessness in Broward County.
On September 29, 2022, Broward County and BPHI (“Parties”) entered into the original Agreement to provide funding in the aggregate amount of $1,240,000, from October 1, 2022, through September 30, 2023, for Rapid Rehousing, Permanent Supportive Housing, and Permanent Supportive Housing for the Pompano Beach Encampment Abatement programs. On September 19, 2023 (Item No. 5), the Commission approved Resolution No. 2023-376, which provided for a First Amendment decreasing the Agreement’s maximum funding amount by $700,000 from $1,240,000 to $540,000, effective October 1, 2023, and removing the Permanent Supportive Housing for the Pompano Beach Encampment Abatement program.
At the request of BPHI, on August 28, 2023, due to BPHI’s underutilization of funds caused by an inability to staff the program, the Parties now desire to amend the Agreement to delete the program for Rapid Rehousing - Individuals and Families. BPHI completed the transition of existing clients to other providers and, effective October 1, 2023, no longer provides these services.
The Office of County Attorney has reviewed and approved the Second Amendment as to form. A copy of the amendment is attached as Exhibit 1.
Approval of this item would give rise to certain employment conflicts under Section 112.313(7)(a), Florida Statutes, which provides that “no public officer… shall have or hold any employment or contractual relationship with any business entity… which is…or is doing business with, an agency of which he or she is an officer or employee...” In accordance with Section 112.313(12), Florida Statutes, Commission approval is required to waive any conflict of interest arising under Section 112.313(7)(a), Florida Statutes. An effective waiver requires a two-thirds vote of the Commission after disclosure of the conflicting relationship (Motion B) in accordance with Section 112.313(12), Florida Statutes. Forms 4A, Disclosure of Business Transaction, Relationship, or Interest, are attached as Exhibit 2 and constitute full disclosure of any existing conflicts.
