Why Action is Necessary

The Broward County Charter requires the posting of notice and a public hearing for adoption of amendments to the Broward County Administrative Code.

Enables the setting of a public hearing during which the Board of County Commissioners (“Commission”) may consider adopting the proposed Resolution Amending the Broward County Administrative Code (“Administrative Code”).

Summary Explanation/Background

Sections 34.3 and 34.13 of the Broward County Administrative Code (“Administrative Code”) establish policies and procedures applicable to the Transportation Surtax Oversight Board Appointing Authority (“Appointing Authority”) and the Transportation Surtax Oversight Board (“Oversight Board”). The proposed Resolution updates and clarifies certain requirements relating to the operation of the Appointing Authority and Oversight Board. These changes are necessitated by changes to the Broward County Code of Ordinances (“Code”) relating to the Appointing Authority and Oversight Board, which are also being considered by the Commission.

 

The proposed amendments revise Appointing Authority quorum requirements, update certain application requirements for Oversight Board vacancies, and modify Oversight Board quorum, attendance, and officer-removal procedures. The amendments also provide a temporary reduced quorum for the Appointing Authority if an appointing entity has dissolved and has no identifiable successor organization, pending amendment of the applicable provisions of the Code. These changes are intended to facilitate the efficient administration and operation of the Appointing Authority and Oversight Board.

 

If Motion A is approved, the Commission will waive Section 18.5.e.1. of the Administrative Code requiring that the Commission first direct the County Attorney’s Office to draft amendments to the Administrative Code. If Motion B is approved, the County Administrator will be directed to publish the applicable Notice of Public Hearing in connection with the Commission’s consideration of the proposed changes to the Administrative Code.
