Why Action is Necessary

Board action is required to grant authority to the County Administrator to approve a mortgage and note modification where such modification is outside the scope of mortgage and note modifications contemplated by Section 27.211 of the Broward County Administrative Code.

 

What Action Accomplishes

Provides authority to the County Administrator to approve a home rehabilitation mortgage modification to add Maker’s spouse and property co-owner to the Original Mortgage and Note.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HOUSING AND URBAN PLANNING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of “ensuring residents have an affordable place to live by offering sustainable, compatible, innovative, accessible, affordable housing options for all income levels, including integrated permanent supportive housing and zoning that helps residents build equity.”

 

Maker applied for the Division’s home rehabilitation program, and Maker and his spouse, Stephanie Kathleen Ford-Fineo (“Ford-Fineo”) were certified as a household eligible for assistance. At the time of the application, Maker was the sole owner of the property where home rehabilitation services are being provided. As such, Maker alone executed the Original Mortgage and Note in favor of Broward County. After executing the Original Mortgage and Note, Maker subsequently executed a Quitclaim Deed which transferred title and ownership of the property to himself and Ford-Fineo. Maker has requested that Ford-Fineo be added to the Original Mortgage and Note. This motion grants the County Administrator the authority to approve the Mortgage and Note Modification Agreement, which adds Ford-Fineo as an additional mortgagor and maker.
