MOTION TO APPROVE Fourth Amendment to Agreement No. 22-CP-HIP-0375-01 between Broward County and Henderson Behavioral Health, Inc., decreasing the Agreement’s maximum funding amount by $835,375, from $1,429,597 to $594,222, effective October 1, 2023, to remove the Specialty Shelter Program, which provides services to individuals experiencing homelessness and severe mental illness; authorize the Mayor and Clerk to execute same; and authorize the County Administrator to take all necessary administrative and budgetary actions to implement the Agreement as amended.

Approval of the motion removes the Specialty Shelter Program (“SSP”) from Agreement No. 22-CP-HIP-0375-01, effective October 1, 2023. This program provided services to individuals experiencing homelessness and severe mental illness.

Summary Explanation/Background
THE HUMAN SERVICES DEPARTMENT AND THE HOUSING OPTIONS, SOLUTIONS, AND SUPPORTS DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.
This action supports the Commission’s value of “building partnerships and working collaboratively with others to meet shared objectives” and the goal of “delivering accessible human services that holistically address the whole person collaboratively and compassionately.” The Fourth Amendment removes the SSP from the Agreement with Henderson Behavioral Health, Inc. (“Henderson”), which provided services to individuals experiencing homelessness and severe mental illness. This will allow the funds to be reallocated among providers within the continuum of care that provide shelter services.
On March 15, 2022, Broward County and Henderson (“Parties”) entered into the original Agreement to provide funding for Case Management, Transitional Housing, and SSP services. The Parties subsequently amended the Agreement through Contract Adjustment 1 on September 15, 2022. Contract Adjustment 1 decreased funding for the initial term, from $1,468,817 to $1,228,817, and the minimum number of clients to be served, effective July 1, 2022. On November 14, 2022, a First Amendment amended the Agreement by adding a third renewal period. On May 26, 2023, a Second Amendment amended the Agreement by removing the Case Management program. On September 19, 2023, a Third Amendment amended the Agreement by increasing the maximum funding amount by $153,622, from $1,073,064 to $1,226,686, effective January 1, 2023, through September 30, 2023, for the Transitional Housing program and amending the unit definition, cost per unit of service, and required staff credentials for Transitional Housing services. The Parties also amended the Agreement through Contract Adjustment 2 on October 17, 2023. Contract Adjustment 2 provided the Agreement’s maximum funding amount effective October 1, 2023.
On July 27, 2023, due to various operational changes implemented by Henderson, Henderson requested to end the provision of SSP services under the Agreement. The Parties now desire to amend the Agreement to delete the SSP from the Agreement. The clients previously served under the SSP have been rehoused in other shelter and housing programs within the continuum of care to ensure no service interruption to the clients previously served through this program.
After the Commission’s adoption of Resolution No. 2023-376 (Item No. 5) on September 19, 2023, Contract Adjustment 2 funded the Transitional Housing program at the level approved by the Commission. As a result, this Fourth Amendment was scheduled for the next available Commission meeting after execution of Contract Adjustment 2.
The Office of County Attorney has reviewed and approved the Fourth Amendment as to form. A copy of the amendment is attached as Exhibit 1.
