AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MOTOR CARRIERS; AMENDING CHAPTER 22½ OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”) TO MODIFY INSURANCE REQUIREMENTS FOR MOTOR CARRIERS OPERATING WITHIN BROWARD COUNTY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
Chapter 22½ of the Code governs motor carrier operations within Broward County, including the insurance requirements imposed on such carriers. Historically, the County has required operators of motor vehicles for hire to maintain specific levels and types of insurance and to file proof of such coverage with the County’s licensing division. Currently, motor carriers operating within Broward County with fewer than nine passengers are required to carry insurance with the liability limits required by state law, while those with nine or more passengers must carry insurance with limits of $500,000 combined for bodily injury.
State law sets various insurance requirements for motor carriers that Broward County regulates under the unified category of “motor carriers with nine or more passengers.” The insurance can vary from $5,000 multiplied by the rated seating capacity of the vehicle up to $100,000 for school buses with a seating capacity of less than 24 pupils to $100,000 per person and $300,000 per incident for bodily injury, and $50,000 for property damage for nonpublic sector buses. Miami-Dade County requires a minimum liability limit of $100,000 per person and $300,000 per occurrence for bodily injury, and $50,000 per occurrence for property damage for this category of motor carrier. Palm Beach County, which has the same insurance requirements for all non-taxi vehicles, regardless of passenger capacity, requires minimum limits of $125,000 per person and $250,000 per occurrence for bodily injury and $50,000 for property damage.
The proposed Ordinance would modify the insurance requirements applicable to motor carriers operating within Broward County with nine or more passengers to align with state law and Miami-Dade County.
