Why Action is Necessary

In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a large-hub commercial service airport in excess of $1,500,000 as a separate line item on the agenda and must provide a reasonable opportunity for public comment.

 

What Action Accomplishes

Ratifies the approval of an emergency procurement of Engineered Material Arresting System blocks and services for the Fort Lauderdale-Hollywood International Airport.

Summary Explanation/Background

THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

There are no goals assigned to this Agreement because an emergency procurement is exempt from application of participation goals.

 

The Engineered Material Arresting System (EMAS) is designed to safely slow and stop an aircraft that has overrun a runway by utilizing beds of crushable concrete blocks placed at the end of the runway. The EMAS beds are required by the Federal Aviation Administration (FAA) as part of Regulatory Standards for the Broward County Fort Lauderdale-Hollywood International Airport’s (FLL’s) Airport Operating Certificate. Runway Safe Inc is the only FAA approved U.S. manufacturer for EMAS. In addition, Broward County Aviation Department (BCAD) has contracted with Boland’s LLC, a contractor approved by Runway Safe Inc, for repair/installation services.

 

On April 9, 2023, a small aircraft overran the east end of the South Runway FLL and damaged the EMAS bed.

 

On April 12, 2023, a record “once in a thousand year” storm dropped 25.91 inches of rain, causing damages to the east and west end of the North Runway at FLL. The EMAS beds at the east and west end of the North Runway were deemed damaged beyond repair and would require full replacement. Broward County (County) declared a local emergency and FLL was closed for two days. On April 14, 2023, FLL reopened for business.

 

On July 19, 2023, the County Administrator approved the emergency procurement for the EMAS bed repairs and replacement requested by BCAD (Exhibit 2).

 

Three separate scopes were approved to enable the replacement and repairs: engineering services, EMAS system/materials, and a specialty contractor to remove, repair, and/or install the system. Two agreements - Runway Safe Inc and Boland’s LLC - require ratification in accordance with Florida Statute’s requirement for large hub airports.

 

On December 13, 2023, the Director of Purchasing approved the Agreement between the County and Runway Safe Inc, in the amount of $8,788,033 (Exhibit 1).

The sources of funding for this emergency procurement are as follows:

Disaster Recovery for Aviation Fund in the amount of $8,474,118 (subject to Federal Emergency Management Agency (FEMA) reimbursement) and FLL Operating Fund in the amount of $313,915 (not subject to FEMA reimbursement).
