Why Action is Necessary
Motion A. In accordance with the Broward County Procurement Code, Section 21.25, Sole Source Procurement, a sole source procurement above the award authority of the Director of Purchasing must be approved by the Board.
Motion B. In accordance with the Broward County Procurement Code, Section 21.47(a), Award and Execution Authority, Board approval is required for awards exceeding $500,000 inclusive of the value of any renewals or extensions provided for in the contract.
In accordance with Section 332.0075(3)(b), Florida Statutes, a governing body must approve, award, or ratify all contracts executed by or on behalf of a commercial service airport in excess of the threshold amount provided in § 287.017 for CATEGORY FIVE [i.e., $325,000] as a separate line item on the agenda and must provide a reasonable opportunity for public comment. Such contracts may not be approved, awarded, or ratified as part of a consent agenda.

Summary Explanation/Background
THE PURCHASING DIVISION AND THE AVIATION DEPARTMENT RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
The Office of Economic and Small Business Development did not assign participation goals for this contract based on the sole source request.
Approval of the sole source designation to Micro Security Solutions, Inc. (MSSI) provides installation, repair, and maintenance of the Broward County Aviation Department (BCAD) Closed Circuit Television (CCTV) system at Broward County Fort Lauderdale-Hollywood International Airport (Airport).
This procurement is a crucial component of the existing CCTV system that is an operational necessity for the safety and security of the public at the Airport. The system interfaces with the security badge door and gate access system to control and video record entries to various locations in the Airport. The CCTV video feed is viewed in real time by the Transportation Security Administration, the Broward Sheriff's Office, the Federal Bureau of Investigations, BCAD, and other law enforcement agencies nationwide.
On June 27, 2022, the Purchasing Division issued a Request for Information (RFI) Notice of Intent to designate sole source/sole brand to ascertain whether there were any other entities able to provide CCTV installation, repair, and maintenance services at the Airport for the existing CCTV system. The RFI yielded three responses. Per BCAD, the three vendors that provided a response cannot perform the services required. Vicon Industries and Smartech Security Corp do not utilize BCAD's standardized equipment and Johnson Controls Security Solutions LLC does not utilize the proprietary software that interfaces with current enterprise access control system. Based on this information, the Director of Purchasing approved the sole source on October 26, 2022.
The sole source memorandum describes specific information regarding the Airport Security Program and is considered to be Sensitive Security Information (SSI). No part of such exhibits may be disclosed to persons without a need-to-know SSI as defined in 49 Code of Federal Regulations Parts 15.11 and 1520.11, except with the written permission of the Administrator of the Transportation Security Administration or the Secretary of Transportation. Pursuant to this regulation, the sole source exhibit is not included as part of the agenda item and will be provided under separate cover by BCAD.
The allowance items included in this contract in the total annual amount of $55,000, includes $20,000 for parts and materials, $15,000 for permits, and $20,000 for specialty subcontractor (Exhibit 1). Expenditures under these allowance items must be approved by the Contract Administrator and will be reimbursed at the contractor's actual incurred cost, without mark-up.
Incumbent Vendor: MSSI. Contract Number and Title: Contract No. BLD2118596B1, Broward County Aviation Department CCTV Installation, Repair and Maintenance. Contract Term: October 15, 2019 through January 12, 2023. Expenditures to date: $3,920,213.
In accordance with the Broward County Living Wage Ordinance, Section 26-101(i), these services are covered services. MSSI has agreed to be bound to the contractual obligations of the Living Wage Ordinance.
The Aviation Department Security Division has reviewed the prices submitted by MSSI and concurs with the recommendation for award (Exhibit 2). One performance evaluation was completed for MSSI; the firm has an overall rating of 5.0 out of a possible 5.0. Copies of the performance evaluations are available upon request.
The Purchasing Division has reviewed the prices submitted by MSSI and determined that the prices submitted are fair and reasonable based upon a comparison to the previous contract pricing (Exhibit 3).
The initial contract period shall start on January 13, 2023 and shall terminate two years from that date.
The amounts referenced in this agenda item were rounded to the nearest whole dollar. Vendor payments will be based on the actual total bid amount. The bid tabulation reflects the actual amount of the award.
