Why Action is Necessary

Board action to accept a conservation easement is authorized by Sections 125.01(3) and 704.06(3), Florida Statutes, and necessary to fulfill the requirements of Environmental Resource License (ERL) No. DF23-1381, issued pursuant to Chapter 27 of the Broward County Code of Ordinances, and of Environmental Resource Permit (ERP) No. 06-110149-P, issued by the South Florida Water Management District (SFWMD).

 

What Action Accomplishes

The action provides for the perpetual maintenance and conservation of the mitigation site by the grantor.

Summary Explanation/Background

THE RESILIENT ENVIRONMENT DEPARTMENT AND THE ENVIRONMENTAL PERMITTING DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Board’s goal of “ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

Pursuant to ERL No. DF23-1381, issued by the Resilient Environment Department on April 30, 2025, and ERP No. 06-110149-P, issued by the SFWMD on June 19, 2025, Griffin 38 - Cooper City, LP, is authorized to create a 3.044-acre off-site wetland mitigation area and upland buffer area at 7400 NW 24th Place in Sunrise (see pages 10 and 11 of Exhibit 1) to offset impacts of proposed development at 10550 Griffin Road in Cooper City. This authorization requires the conveyance of a Joint Deed of Conservation Easement (Exhibit 1) to the County and SFWMD, guaranteeing the area's perpetual preservation and maintenance by the grantor.

 

The Joint Deed of Conservation Easement has been reviewed and approved as to form by the Office of the County Attorney.
