August 14, 2001 - Item No. 9 - The Broward County Board of County Commissioners approved a subsurface fiber-optic cable easement granted from Broward County to Concert Global Networks USA, L.L.C.

 

Summary Explanation/Background

THE PARKS AND RECREATION DEPARTMENT, THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT, AND THE REAL PROPERTY AND REAL ESTATE DEVELOPMENT DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

On August 14, 2001 (Agenda Item No. 9), the Board of County Commissioners authorized the County Administrator to execute the Contract for Sale and Purchase between Broward County (“County”), and AT&T Enterprises, L.L.C.’s predecessor in interest, Concert Global Networks USA, L.L.C. (“Concert Global Networks”) in the amount of $61,000 for the sale of a 25-year term sub-surface fiber optic cable easement (“Original Easement”) comprising 9342.4 +/- square feet in the city of Hollywood, Florida located at North Surf Road and Granada Avenue, which is now Cody Street (“Property”). The Original Easement included an option to extend the term with the County’s consent. Broward County has a one-sixth interest in this Property, and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (“TIITF”) has a five-sixths interest. TIITF granted a perpetual easement to Concert Global Networks.

 

This Amendment revises the Original Easement executed on August 14, 2001, creating a perpetual easement between the County and AT&T Enterprises, L.L.C., which is consistent with TIITF’s perpetual easement granted to Concert Global Networks on the Property.

 

All documents have been reviewed and approved as to form by the Office of the County Attorney.
