Why Action is Necessary
Section 125.01(2)(p), Florida Statutes authorizes the Board to enter into agreements with other governmental agencies. Board action is required for an amendment to an Agreement that modifies the scope or time of the Agreement for a grant award, and to recognize the reallocation of the award within the Public Works and Environmental Services Department.
What Action Accomplishes
This action provides funding for air quality program support in Broward County and allows for the reappropriation of this funding.

Summary Explanation/Background
THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE NATURAL RESOURCES DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
This item supports the County’s value of “Collaborates: Building partnerships and working collaboratively with others to meet shared objectives” and goal of “Ensuring accessible, seamlessly integrated investments in renewable energy, sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”
The Air Quality Program is a federal and state approved local air quality program responsible for protecting and improving air quality in Broward County, in accordance with state and federal regulations. The Natural Resources Division implements a federal and state approved local air pollution control program responsible for protecting and improving air quality in Broward County. On November 12, 2024 (Item No. 26), the Board approved EPA grant award 5Q-03D15124-0, with funds designated to help pay for an upgrade of the Broward County Ambient Air Monitoring Network with an Air Monitoring shelter at the Sunset Lakes Community Center at 2801 Southwest 186 Avenue in Miramar, Florida. The amended grant agreement reallocates those funds to the County Air Program’s required Photochemical Assessment Monitoring Station (PAMS) program for Fiscal Years 2026 and 2027. Anticipated funding shortfalls in the U.S. EPA State and Local Air Grant, which supports PAMS activities (Exhibit 1), necessitates this reallocation.
Motion A accepts the U.S. EPA 103 5Q-03D15124-1 grant amendment over the budget period of June 1, 2024, through September 30, 2027. The grant amendment was received from the U.S. EPA on September 25, 2025 (Exhibit 1).
Motion B adopts a budget Resolution for the award under this agreement in the amount of $0. This budget Resolution reallocates the award to reflect the amended scope (Exhibit 2).
The County Air Program has been supported by the U.S. EPA Section grants for over thirty years. The program includes implementation of the 1990 Clean Air Act Amendments, ambient air monitoring, permitting and compliance verification, asbestos inspections, air quality analysis and planning, and public outreach.
Because the County is a recipient of funds from a federal agency under this agreement, the County’s standard terms are not included. Moreover, the agreement imposes an annual Federal Financial Report and an annual Performance Report requirement on the County. However, this agreement has been provided legal review and has been approved as to form by the Office of the County Attorney.
This Grant Agreement reallocation was approved by the Office of Intergovernmental Affairs Grant Section and the Office of Management and Budget.
