Why Action is Necessary

Board of County Commissioners’ approval is required under Broward County Administrative Code, Section 20.31(b)(3), for the execution of all grant agreements and amendments.

Authorizes the County Administrator or her written designee to execute the Revised Award Agreement for federal funding relating to the Sheridan Bridge Repair Project and allows the County Administrator or her written designee to administer and execute any future amendments, change orders, or other required documentation related to the Revised Award Agreement in compliance with federal requirements, provided such documents do not impose any additional financial obligation on the County, and subject to review and approval of same for legal sufficiency by the County Attorney’s Office.

Summary Explanation/Background

THE PUBLIC WORKS AND ENVIRONMENTAL SERVICES DEPARTMENT AND THE HIGHWAY AND BRIDGE MAINTENANCE DIVISION RECOMMEND APPROVAL OF THE ABOVE MOTION.

 

This item supports the Commission Goal of “Resilient Community: Ensuring accessible, seamlessly integrated investments in sustainable practices, manufacturing, resilient infrastructure, and environmental protection.”

 

On the August 21, 2025, Commission meeting agenda (Item No. 11), the County Administrator provided notice to the Commission that during the Commission’s summer recess the County Administrator executed the Federally Funded Economic Development Initiative - Community Project Funding (EDI-CPF) Grant Agreement (Grant No. B-24-CP-FL-0658) with the U.S. Department of Housing and Urban Development (HUD) for the Sheridan Bridge Repair Project (Original Grant Agreement). The Agreement provided for the County to receive federal grant funding in the amount of $4,000,000 from HUD to be used in connection with the Sheridan Bridge Repair Project. The same agenda item also notified the Commission that the County Administrator had also approved a budget Resolution to allow for the appropriation of the grant revenue funds provided by HUD.

 

After the County Administrator’s execution of the Original Grant Agreement, HUD did not sign and instead issued an updated standard agreement template that added new policy and program-specific requirements applicable to the grant. As a result, HUD is now requiring that the County execute the Revised Award Agreement and all associated addenda prior to HUD’s final approval of the grant. The Revised Award Agreement contains a variety of provisions that are non-standard to County form agreements (e.g., prohibition of using federal funds for projects involving eminent domain, prohibition on promoting gender ideology, prohibition against using funds to promote illegal immigration, Build America/ Buy America standards, and Section 3 HUD worker hiring standards), but HUD will not agree to modification or removal of such provisions. The County Attorney’s Office has reviewed and approved the Revised Award Agreement for legal sufficiency and discussed the requirements of the grant with the agency representatives involved with the Project. Additionally, the County submitted a justification request to HUD seeking flexibility regarding pre-nexus procurement, as the County had already begun and nearly completed its two-step procurement process before receiving notice of the federal award. HUD’s approval of the County’s justification request and the agency’s execution of the Revised Award Agreement is pending completion and submission of the environmental review of the project.

 

If this item is approved, the County Administrator or her written designee will execute the Revised Award Agreement, including all associated addenda (Exhibit 1). The Revised Award Agreement does not modify the funding amount or period of performance. The total federal award remains $4,000,000. Further, the County Administrator or her written designee will be granted authority to execute future amendments, change orders, and other documents relating to the grant, provided they do not impose additional financial obligations on the County associated with the grant, and subject to review and approval for legal sufficiency by the County Attorney’s Office.

 

The Revised Award Agreement will commence upon HUD’s execution and will conclude on August 31, 2032.

Fiscal Impact/Cost Summary

There is no change to the previously approved financial commitment for the Sheridan Bridge Repair Project. The project is funded at $12.7 million, including $4 million in HUD funds, $4 million from the Florida Department of Transportation, and $4.7 million from the County’s Surtax funding.
