MOTION TO APPROVE subaward grant agreement between Broward County and the Florida Division of Emergency Management in the amount of $370,299 to support Broward County's emergency management and preparedness program for the period from October 1, 2023 to March 31, 2024, which requires a dollar-for-dollar match by the County; authorize the County Administrator to execute the Agreement and any amendments thereto that do not increase the percentage of local match required of the County, subject to review for legal sufficiency by the Office of the County Attorney, and to take the necessary administrative and budgetary actions for the implementation of the grant award.

Summary Explanation/Background
REGIONAL EMERGENCY SERVICES AND COMMUNICATIONS AND THE EMERGENCY MANAGEMENT SECTION RECOMMEND APPROVAL OF THE ABOVE MOTIONS.
In accordance with the Robert T. Stafford Disaster Relief and Emergency Assistance Act, as amended, 42 U.S.C. 5121-5207, as authorized by Section 662 of the Post Katrina Emergency Management Reform Act, the Emergency Management Performance Grant (EMPG) funds may be used for all-hazards emergency management operations, staffing, and other planning, training, or coordination activities as specified in the EMPG Fiscal Year 2023 Scope of Work.
Retroactive approval is requested, as the grant agreement was received after October 1, 2023. Based on Fiscal Year legislative appropriations, Broward County's Federal EMPG award this Fiscal Year is $370,299. The award must be expended by March 31, 2025. This sub-grant agreement requires a dollar-for-dollar match by the County. The grant funding will be utilized to support four existing positions within the Emergency Management Section.
The Grant Agreement is on a state-provided form utilized by FDEM and includes clauses that deviate from the County’s standard terms and conditions, including, but not limited to: (a) venue for any litigation that may arise from the agreement is in Leon County, (b) a requirement that the County indemnify, defend, and hold harmless FDEM against any actions, claims, or damages arising out of, relating to, or resulting from any negligent or wrongful acts by the County, and (c) FDEM may terminate the agreement for its convenience upon 30 days’ notice.
The Grant Agreement will be distributed as additional material.

The total amount of the EMPG award is $370,299. The County will be reimbursed for costs not to exceed $370,299 for the EMPG award. The County’s dollar-for-dollar match, in the amount of $370,299 has been budgeted within the Emergency Management Section’s general fund account.
