AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO TAX CERTIFICATE SALES; REPEALING SECTION 31½-4 OF THE BROWARD COUNTY CODE OF ORDINANCES (“CODE”); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Why Action is Necessary
A Resolution directing the County Administrator to publish notice of public hearing to consider enactment of the Ordinance was adopted by the Board of County Commissioners (“Board”) at its meeting of September 4, 2025.

Summary Explanation/Background
Pursuant to a recent amendment to the Florida Constitution, the elected Tax Collector now performs the duties relating to the annual sale of tax certificates. These duties were previously performed by the Broward County Finance and Administrative Services Department (“FASD”). Because certificate sales are no longer performed by FASD, the proposed Ordinance would repeal the section of the Code that established the rules of the sales when conducted by FASD.
