Direction by the Board of County Commissioners (“Commission”) is required for the County Attorney’s Office to draft an Ordinance amending the Broward County Code of Ordinances (“Code”).

Summary Explanation/Background

Many residential communities have contracts with companies that service and maintain elevators (“Elevator Service Company”). Particularly if a building has only one elevator, it is critical that the Elevator Service Company promptly repair an inoperative elevator. Otherwise, residents with physical limitations may be unable to leave or return to their residential units.

 

The County Attorney’s Office, in collaboration with County staff, is directed to research permissible mechanisms to ensure inoperative elevators are promptly fixed, and if the Elevator Service Company under contract cannot, for whatever reason, promptly fix the elevator, a mechanism should be in place to ensure that the residential community has timely notice thereof so the community may seek to obtain the repair from another source.
