MOTION TO ADOPT Resolution directing the County Administrator to publish Notice of Public Hearing to be held on September 10, 2026, at 10:00 a.m., in Room 422 of Governmental Center East to consider enactment of a proposed Ordinance, the title of which is as follows:
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO MOTOR VEHICLES AND TRAFFIC; REPEALING SECTION 23.8 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"); AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
In 1992, the Florida Legislature ("Legislature") amended Section 316.655, Florida Statutes, to authorize counties to assess an optional $12.50 surcharge on traffic tickets to fund county participation in an intergovernmental radio communications program. In 1994, the Commission enacted Ordinance No. 94-40 to adopt the surcharge, which was codified in Section 23-8. In 1996, the Legislature amended Sections 316.655 and 318.21, Florida Statutes, to make the $12.50 charge mandatory for all counties and an inherent part of the traffic fine. Section 23-8 of the Code is therefore redundant and should be repealed.
