Summary Explanation/Background

The Administrative Code provides for annual rate and fee increases for the maximum nonconsent towing and immobilization rates at the rate of the lower of the Consumer Price Index or three percent. This item would direct the County Attorney’s Office to consult with County staff regarding a more appropriate basis for the annual rate and fee increases and to prepare a Resolution for Commission consideration at the first meeting after summer recess.

This item is submitted after the deadline for supplemental items due to the fact that the sponsor only recently learned of the current method of establishing the annual increase. Postponement until the next Commission meeting, which would be after summer recess, will likely preclude Commission consideration of the appropriate rate modification for the annual rate increase that will take effect on October 1, 2026.
