Summary Explanation/Background

The Cone of Silence does not draw distinctions in its application between a “regular” solicitation and a “two-step” solicitation (which is a solicitation in which the first step is a solicitation to qualify vendors and the second step is a solicitation to evaluate the qualified vendors’ proposals). In practice, the Cone of Silence has been applied to two-step solicitations from the beginning of the first step until the end of the second step. This item would direct the County Attorney’s Office to prepare an amendment to the Cone of Silence Ordinance to codify the County’s current practice regarding the application of the Cone of Silence to two-step solicitations.
