AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF BROWARD COUNTY, FLORIDA, PERTAINING TO SCHOOL CONCURRENCY; AMENDING SECTION 5-182.9 OF THE BROWARD COUNTY CODE OF ORDINANCES ("CODE"), IMPLEMENTING CHAPTER 2022-122, LAWS OF FLORIDA, REGARDING SCHOOL CONCURRENCY; AND PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.

Summary Explanation/Background
Chapter 2022-122, Laws of Florida (SB 706), requires The School Board of Broward County ("School Board") to notify the County that capacity is available for residential development within thirty (30) days after receipt of a developer's legally binding commitment to provide mitigation proportionate to the demand for public school facilities to be created by actual development of the property. The proposed Ordinance implements this legislation by amending Section 5-182.9 of the Broward County Code of Ordinances ("Code") to vest developments for purposes of school concurrency where the County has received such notification from the School Board that capacity is available for the development.
